These Terms and Conditions (“Terms”) govern your access to and use of the Beat The Property Agent™ website, property platform, BTPA Blueprint™, Property Professional Directory and associated services.

Beat The Property Agent™ (“BTPA”, “we”, “us” or “our”) is operated by Beat The Property Agent Ltd, a company registered in England and Wales.

By creating an account or using our platform, you agree to these Terms.

 

1. About BTPA

BTPA is an independent property listings, education and transaction-preparation platform designed to give property buyers and sellers greater information, choice and control over their property journey.

BTPA provides technology, educational resources, property listing functionality, communication tools and access to independent property professionals.

BTPA is not an estate agent, conveyancer, mortgage broker, surveyor, financial adviser or any other specialist.

Unless expressly stated otherwise, we do not act as an agent for a buyer, seller or property professional.

We do not negotiate or conclude property transactions on behalf of users.

 

2. Eligibility

You must be at least 18 years old to create an account or independently use BTPA in connection with a property transaction.

You must provide accurate, current and complete information when creating or maintaining an account.

You are responsible for keeping your login credentials secure and for activity conducted through your account.

 

3. Seller Responsibilities

Sellers remain responsible for their property and property listing.

Information provided within a listing must, to the best of the seller’s knowledge, be accurate, truthful and not misleading.

Sellers must not deliberately conceal or misrepresent material information about a property.

Where BTPA provides guidance concerning information that should be disclosed, this does not transfer responsibility for the accuracy of that information to BTPA.

Sellers are responsible for obtaining appropriate professional advice where required.

 

4. Property Listings

BTPA may provide tools enabling sellers to create, edit and publish property listings.

We may establish minimum information requirements before a listing can be published.

BTPA may refuse, suspend, amend the visibility of or remove a listing where we reasonably believe that:

• information is materially inaccurate or misleading;
• required information has not been provided;
• the property does not exist or the user is not authorised to advertise it;
• the listing infringes another person’s rights;
• fraudulent or suspicious activity is involved;
• the listing breaches these Terms; or
• publication could expose BTPA or its users to legal or security risks.

 

5. Property Information

BTPA aims to encourage better preparation and greater transparency.

However, information displayed on BTPA should not replace appropriate professional investigations.

Buyers should undertake their own due diligence and obtain appropriate legal, financial and surveying advice before committing to a property purchase.

 

6. Valuations and Asking Prices

Where BTPA enables or encourages sellers to obtain professional valuation advice, any valuation is provided by the relevant independent professional.

BTPA does not guarantee the accuracy of a valuation, asking price, estimated value or eventual sale price.

Property values can change and the amount ultimately agreed between buyer and seller remains their decision.

 

7. Buyers

Buyers are responsible for ensuring that information they provide concerning their identity, financial position, mortgage position or ability to proceed is accurate.

A buyer readiness, verification or pre-qualification status does not constitute a guarantee that finance will be available or that a transaction will complete.

Mortgage lending decisions remain entirely with the relevant lender.

 

8. Direct Communication

BTPA may allow buyers and sellers to communicate directly.

Users must communicate lawfully, respectfully and honestly.

BTPA is not responsible for agreements, representations or commitments independently made between users.

Users should obtain appropriate professional advice before entering legally binding commitments.

 

9. Independent Property Professionals

BTPA may provide access to independent professionals including surveyors, mortgage brokers, conveyancers, property stagers, removal providers and other property specialists.

Unless explicitly stated otherwise, these professionals are independent businesses.

They are not employees, agents or representatives of BTPA.

Users remain free to choose which professionals they instruct.

BTPA does not require users to instruct a particular professional as a condition of using the platform.

Any agreement for professional services is between the user and the relevant professional.

 

10. No Referral-Fee Model

BTPA is designed to provide users with independent choice.

Where BTPA states that a service or directory operates without referral fees, professionals do not obtain preferential recommendations.

If our commercial arrangements materially change, we will update the relevant terms and disclosures.

 

11. The BTPA Blueprint

The BTPA Blueprint provides educational information and guidance intended to help users understand and prepare for their property journey.

It does not constitute legal, financial, mortgage, surveying, tax or other regulated professional advice.

Users should seek advice from appropriately qualified professionals concerning their individual circumstances.

 

12. No Guarantee of Sale or Completion

BTPA cannot guarantee:

• that a property will sell;
• the price a property will achieve;
• that a buyer will proceed;
• that mortgage finance will be obtained;
• that a transaction will complete;
• how long a transaction will take; or
• that a property professional will achieve a particular outcome.

Property transactions depend upon numerous parties and circumstances outside BTPA’s control.

 

13. User Content

Users may upload information, text, property descriptions, photographs, floorplans, documents and other material (“User Content”).

You retain ownership of your User Content.

By uploading content to BTPA, you grant BTPA a non-exclusive licence to host, reproduce, display, process and distribute that content to the extent reasonably necessary to operate and promote the relevant BTPA service or property listing.

You must have the necessary rights or permission to upload the content.

 

14. Intellectual Property

The BTPA website, platform, branding, software, structure, educational content and original materials are protected by intellectual property laws.

Beat The Property Agent™, BTPA Blueprint, Readiness Checklists and Property Information Questionnaires and all associated branding and materials may not be copied, reproduced, commercially exploited or represented as another party’s work without permission.

Property information and User Content remain subject to the rights of their respective owners.

 

15. Prohibited Use

You must not use BTPA to:

• commit or facilitate fraud;
• impersonate another person;
• create false property listings;
• deliberately provide misleading property information;
• harvest user information;
• send spam;
• harass or threaten another user;
• distribute malware;
• attempt unauthorised access to our systems;
• scrape the platform contrary to our instructions or applicable law;
• infringe intellectual property rights;
• circumvent security measures; or
• use BTPA for unlawful purposes.

 

16. Account Suspension and Termination

We may restrict, suspend or terminate an account where we reasonably believe a user has:

• materially breached these Terms;
• engaged in fraud or suspicious behaviour;
• created risks for another user;
• abused the platform;
• repeatedly provided materially misleading information; or
• used BTPA unlawfully.

Where appropriate, we will explain the reason and provide an opportunity to contact us.

 

17. Availability of the Platform

We aim to provide a reliable service but cannot guarantee uninterrupted availability.

We may temporarily restrict access for maintenance, security, upgrades or circumstances outside our reasonable control.

 

18. Liability

Nothing in these Terms excludes liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable consumer law, BTPA is not responsible for losses caused by independent decisions or actions of buyers, sellers, property professionals, lenders, conveyancers or other third parties.

Nothing in these Terms affects statutory rights that cannot legally be excluded.

 

19. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data protection law.

 

20. Changes to These Terms

We may update these Terms where our platform, services or legal obligations change.

Material changes will be communicated where appropriate.

 

21. Governing Law

The laws of England and Wales govern these Terms.

If you are a consumer, you may also benefit from mandatory legal protections applicable where you live.
