Welcome to Beat The Property Agent (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your access to and use of our platform, services, website, and applications (collectively, the “Platform”). By using the Platform, you agree to be bound by these Terms.
1. Eligibility
To use our Platform, you must be at least 18 years old and capable of entering into a legally binding contract. By using the Platform, you confirm that you meet these requirements.
2. Services Offered
We provide a digital platform that enables:
○ Property sellers to list, price, market, and sell their properties autonomously;
○ Property buyers to browse and submit offers on properties;
○ Property professionals (e.g., brokers, surveyors, conveyancers, tradespeople) to connect with users through a subscription-based directory.
3. User Accounts
○ You must register an account to access certain features.
○ You are responsible for maintaining the confidentiality of your login credentials.
○ You agree to provide accurate and complete information and to update it as necessary.
4. Fees and Payments
○ Property Sellers: A one-time flat fee is charged for listing a property.
○ Property Professionals: A recurring subscription fee applies.
○ All payments are non-refundable.
○ Fees may change from time to time, but you will be notified in advance.
5. No Refund Policy
All fees paid to us are non-refundable, including but not limited to subscription fees, listing fees, or service usage charges.
6. Bidding & Buyer Requirements
○ All buyers must fulfill pre-bid criteria, including providing valid and current proof of funds before submitting any offer.
○ Offers or bids will not be accepted without demonstrable proof of funds.
○ If proof of funds is found to be fraudulent, invalid, expired, or cancelled by a lender or financial institution, the seller reserves the right to cancel the offer or bid immediately, without liability.
○ It is the buyer’s responsibility to ensure the authenticity and continued validity of any financial documents submitted.
○ We reserve the right to verify any documentation and suspend accounts found to have submitted false or misleading information.
7. Seller Responsibilities & Property Ownership
○ All property sellers must be honest, accurate, and truthful in all representations related to the property being listed.
○ You must be the legal owner of the property being sold.
○ In cases of joint or multiple ownership, you must have the full, documented consent of all legal owners before proceeding with the sale.
○ If any discrepancies or misrepresentations are discovered or reported to Beat The Property, we reserve the right to investigate and take appropriate action, including suspending listings or accounts, and where necessary, reporting the matter to relevant legal authorities.
○ We take integrity and transparency seriously and will act in accordance with applicable laws and regulations.
8. Use of Property Professionals
○ Buyers and sellers may contact and instruct the services of property professionals listed in our directory at their own risk.
○ While we make every effort to ensure that professionals listed are appropriately qualified and licensed (where applicable), Beat The Property Agent does not guarantee their performance and accepts no responsibility or liability for any outcomes, damages, or losses resulting from your engagement with them.
○ We encourage users to conduct their own due diligence before entering into any agreements with third-party service providers.
○ We welcome complaints regarding any individual or business listed in our directory. All complaints will be handled through a robust and fair internal process, and we reserve the right to take appropriate action at our sole discretion.
9. User Conduct
You agree not to:
○ Post false, misleading, or illegal listings;
○ Use the Platform for unlawful purposes;
○ Interfere with the operation of the Platform or the use of it by others;
○ Collect or store personal information of other users without consent.
10. Data Privacy
We collect and process personal data in accordance with our Privacy Policy. By using the Platform, you consent to such data collection and processing.
11. Third-Party Services
We may integrate with or promote third-party services (e.g., mortgage brokers, surveyors). We are not responsible for the conduct, content, or performance of any third party unless explicitly stated.
12. Intellectual Property
All content on the Platform, including but not limited to software, branding, and data, is our property or licensed to us. You may not reproduce, distribute, or use our content without permission.
13. Termination
We reserve the right to suspend or terminate your access to the Platform at our discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful.
14. Disclaimers

15. Limitation of Liability
