Prepare It Properly. Disclose It Early. Sell With Fewer Surprises.
Selling a freehold property should not begin with simply putting it online.
The BTPA Blueprint™ encourages sellers to gather important information, documents and evidence before marketing begins, so buyers can make better-informed decisions and the conveyancing process can get underway with fewer avoidable delays.
This questionnaire is designed to help a freehold seller prepare key property information in advance.
It does not replace the TA6 Property Information Form, title documents, searches, surveys, conveyancing enquiries or legal advice. Your conveyancer should review the information and supporting documents before the sale becomes legally binding.
Understanding freehold and restrictive covenants:
Before completing your Freehold Seller Property Information Questionnaire, it helps to understand these terms:
Freehold means you own the property and the land it stands on, with no fixed time limit on ownership. However, there may still be legal obligations or restrictions affecting how you use it.
Restrictive covenants are legal conditions that limit what you can do with the property or land. For example, they might restrict building on part of the land or using the property for certain business activities.
Where can you find this information?
For registered properties in England and Wales, restrictive covenants may appear in the property’s title register, including the official copies your conveyancer obtains from HM Land Registry -sometimes called Official Copy Entries (OCEs). The register may set out the wording or refer to a separate deed containing the details.
If you are unsure whether a covenant affects your property or how to answer a question, ask your conveyancer to check and explain it. You do not need to interpret legal wording on your own.
